Privacy and Confidentiality – Information for Workers

Re-Start Consulting is an independent, accredited workplace rehabilitation provider that operates within the State Workers Compensation system and within the Comcare Workers Compensation system. Re-Start Consulting’s role is to assist injured workers return to work by providing specialist advice and services in consultation with workers, employers, insurers and treating parties that are tailored to their specific circumstances.

Confidentiality has been defined by the International Organization for Standardization (ISO) as "ensuring that information is accessible only to those authorized to have access". Re-Start Consulting is committed to complying with Commonwealth legislation and the National Privacy Principles established by the Privacy Act 1988.

Questions you may have regarding your Personal Information:
What is personal information?
Personal information is any information whereby your identity may be ascertained. The information collected may include an individual's:
  • Name
  • Date of birth
  • Contact details (telephone; postal and residential addresses)
  • Nature of injury
  • Health information
  • Employment details including occupation, work history and rate of pay/salary
  • Medical history and
  • Other information that we consider necessary
Collecting Personal Information –Why is this required?
We need to collect personal information to provide the services we are requested to deliver.  Failing to provide Re-Start Consulting with certain personal information means that, potentially, we may not be able to provide the relevant service to the individual concerned. If necessary personal information is not provided, we will be unable to do business with you.

How is your information collected?
Where it is possible, we will collect personal information directly from you. This may take place when you complete documents such as administrative forms, questionnaires or when you give us personal information in person, over the telephone or through our websites.

In certain circumstances, we will collect personal information from third parties. For example, we may need to collect personal information from:
  • your nominated treating doctor and any other treating practitioner who, by agreement is deemed necessary;
  • appointed return to work coordinator of your employer;
  • referring agency; and
  • persons/organisations engaged by Re-Start Consulting;
How do we use your personal information?
To ensure confidentiality, details of your personal information will be passed on to you only if we are satisfied that the information relates to you. We are permitted to use or disclose personal information held about you:
  • Where you have consented to the use or disclosure;
  • Where we reasonably believe that the use or disclosure is necessary to lessen or prevent a serious, immediate threat to someone's health or safety or the public's health or safety;
  • Where we reasonably suspect that unlawful activity has been, is being or may be engaged in and the use or disclosure is a necessary part of our investigation or in reporting the matter to the relevant authorities;
  • Where such use or disclosure is required under or authorised by law (for example, to comply with a subpoena, a warrant or other order of a court or legal process);
  • Where we reasonably believe that the use or disclosure is reasonably necessary for prevention, investigation, prosecution and punishment of crimes or the preparation for, conduct of, proceedings before any court or tribunal or the implementation of the orders of a court or tribunal by or on behalf of an enforcement body.

What access and control do you have over our use of your information?

Please note Re-Start Consulting are unable to provide you with information we are not the author of such as reports from Specialist Doctors.

You are able to withdraw your consent for Re-Start Consulting to have authority to obtain/release information at any time; however your injury management and/or Workers Compensation benefits could be affected.
